6. Bezahlung

  • Kreditkarte (Visa, Mastercard, American Express, Maestro, UnionPay)
  • Shop Pay
  • PayPal
  • Apple Pay
  • Google Pay
  • iDEAL | Wero, Bancontact, EPS, BLIK, Satispay, MobilePay

Terms and Conditions

1. Scope

All orders placed through our online shop are subject to the following terms and conditions. Our online shop is directed exclusively at consumers.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with Filouino – Bühring & Exner GbR, Neckarstraße 75, 72160 Horb am Neckar, Germany, email: orders@filouino.com.

By listing products in the online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. You will receive a confirmation by email immediately after submitting your order.

3. Contract language, storage of contract text

The languages available for the conclusion of the contract are: German, English.

We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Prices, currency and delivery terms

All prices include the applicable value added tax. Shipping costs are added to the stated product prices; further information on the amount of the shipping costs can be found on our shipping page.

If prices are displayed to you in a currency other than euro, the total amount displayed at checkout in the currency shown there is the amount relevant to the contract.

We deliver by post/courier only; collection of the goods in person is not possible.

For deliveries to countries outside the European Union, additional import charges (e.g. customs duties and import VAT) may apply in the country of destination which are not included in the purchase price or the shipping costs. Where DDP (Delivered Duty Paid) applies to a delivery, all applicable import charges are already calculated and collected at checkout; no additional customs fees will be charged upon delivery (see section 12). In all other cases, these charges are borne by the recipient in the country of destination; we have no influence on their amount.

5. Right of withdrawal

Consumers have a fourteen-day right of withdrawal for distance contracts. The complete instructions for withdrawal including the model withdrawal form can be found on our withdrawal page; it will also be sent to you in text form together with the order confirmation.

The right of withdrawal does not apply to consumers who, at the time of conclusion of the contract, do not belong to any member state of the European Union and whose sole habitual residence and delivery address are outside the EU at that time. For these orders, all sales are final.

6. Payment

The following payment methods are available in our shop. Which payment methods are offered to you depends on your country of residence and the device you use; the available payment methods are displayed during the ordering process:

  • Credit card (Visa, Mastercard, American Express, Maestro, UnionPay)
  • Shop Pay
  • PayPal
  • Apple Pay
  • Google Pay
  • iDEAL | Wero, Bancontact, EPS, BLIK, Satispay, MobilePay

When you place your order, you provide your payment details. After you have been authenticated as the legitimate user of the selected payment method, the payment transaction is carried out automatically.

For the payment service providers PayPal, Apple (Apple Pay) and Google (Google Pay) as well as for the local methods iDEAL/Wero, Bancontact, EPS, BLIK, Satispay and MobilePay, you will be redirected to the page of the respective provider during the ordering process or you use the payment function stored there; the privacy policy of the respective provider applies. In order to pay the invoice amount, you may need to be registered there or register first, authenticate yourself with your login details and confirm the payment instruction to us. Further information is provided during the ordering process.

7. Retention of title

The goods remain our property until payment has been made in full.

8. Transport damage

If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to give notice of damage or to contact us has no consequences whatsoever for your statutory rights and their enforcement, in particular your warranty rights. However, you help us to enforce our own claims against the freight forwarder or the transport insurance.

9. Warranty and guarantees

Statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.

10. Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation

  • in cases of injury to life, body or health
  • in cases of intent or grossly negligent breach of duty
  • in respect of guarantee promises given, where agreed, or
  • insofar as the scope of application of the German Product Liability Act (Produkthaftungsgesetz) is opened.

In the event of a breach of essential contractual obligations the fulfilment of which is essential for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives or vicarious agents, liability is limited in amount to the foreseeable damage typical for this type of contract at the time of conclusion of the contract.

Otherwise, claims for damages are excluded.

11. Dispute resolution

We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 of the German Consumer Dispute Resolution Act, VSBG).

12. International orders

(1) For customers residing outside the European Union, all contracts are governed by German law. Mandatory consumer protection provisions of the country in which the customer is resident remain unaffected. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

(2) Where we offer the DDP procedure (Delivered Duty Paid) for a delivery country, all applicable import duties, customs clearance fees and taxes are calculated and collected at checkout; no additional customs fees will be charged upon delivery. Whether the DDP procedure applies to your delivery country is shown in the ordering process. We currently offer the DDP procedure for deliveries to the United States.

(3) The right of withdrawal of consumers who do not belong to any EU member state and whose sole habitual residence and delivery address are outside the EU is excluded pursuant to section 5; for these orders all sales are final.

(4) Liability is governed exclusively by the provisions of section 10.
