We are pleased about your interest in our online shop. The protection of your personal data is important to us. Below we inform you in detail about the processing of personal data when using our online shop at www.filouino.com.

1. Hosting and shop system (Shopify)

Our online shop is operated on the Shopify e-commerce platform. The provider is Shopify Commerce International Ltd., Victoria Buildings, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”). When you visit and use our shop (in particular when you call up pages, add items to the cart and place an order), personal data (e.g. IP address, access data, customer and order data) is processed on Shopify’s systems. The processing takes place on the basis of a data processing agreement pursuant to Art. 28 GDPR (Shopify Data Processing Agreement). The legal bases for the processing are Art. 6 (1) (b) GDPR (performance of contract) and Art. 6 (1) (f) GDPR (secure and efficient shop operation). Shopify processes data on servers inside and outside the European Union, in particular in Canada and the USA. Any transfers to third countries are safeguarded by Shopify’s contractual protection measures (including standard contractual clauses, EU-US Data Privacy Framework) and the data processing agreement concluded between us and Shopify. Further information: Shopify’s privacy statement (https://www.shopify.com/legal/privacy).

2. Cookies and consent management

Our online shop uses cookies and comparable technologies. Technically necessary cookies (e.g. for the shopping cart and the checkout) are required for the operation of the site and are set on the basis of Art. 6 (1) (f) GDPR. In addition, Shopify only sets statistics, personalization and marketing signals if you have consented to this via our cookie banner (Art. 6 (1) (a) GDPR). The cookie banner is displayed to visitors from the European Union (including Norway, Iceland and Liechtenstein), the United Kingdom and Switzerland. No analysis or marketing tools from third-party providers (e.g. Google Analytics, Meta pixel) are active.

Key cookies used by us:

Cookie Purpose Duration
_shopify_y Assigning the visit for shop statistics (annual value) approx. 1 year
_shopify_s Assigning the visit for shop statistics (session) approx. 30 minutes
cart Storing the shopping cart end of session
Further Shopify standard cookies Technical operation of the shop and the checkout (e.g. security features) session up to max. 2 years

You can find Shopify’s complete cookie list in Shopify’s cookie policy (https://www.shopify.com/legal/cookies). You may revoke your consent at any time, e.g. via the “Manage cookie preferences” link in the footer of our pages; you can also delete or block cookies in your browser settings.

3. Order processing and customer account

When you place an order, we process the data required for the performance of the contract (e.g. name, delivery and billing address, email address, order and payment data). The legal basis is Art. 6 (1) (b) GDPR. You will receive the order confirmation, the terms and conditions and the withdrawal instructions by email; for this purpose we store the contract text including these documents for the statutory retention periods (6 years under Section 257 HGB, up to 10 years under Section 147 AO). You can optionally create a customer account; the data processed for this purpose (name, email address, if applicable invoice and default address, order history) is used to provide the account (Art. 6 (1) (b) GDPR). You may delete your customer account at any time by sending a message to orders@filouino.com.

4. Payment processing

Payment is processed via the payment methods we offer. For payments via Shopify Payments (including Shop Pay and the local methods iDEAL | Wero, Bancontact, EPS, BLIK, Satispay and MobilePay), the data required for payment processing (e.g. contact details, billing address, payment information, fraud prevention data) is processed by Shopify on behalf of the respective payment service provider; the data processing takes place pursuant to Art. 6 (1) (b) GDPR for the performance of the contract. For payments via PayPal, the privacy policy of PayPal (Europe) S à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg applies. For Apple Pay, Apple’s privacy statement applies; for Google Pay, that of Google (Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland). For the purpose of fraud prevention and the optimisation of our payment processes, we pass on the data required for this to the service providers involved as part of data processing on our behalf (Art. 6 (1) (f) GDPR). The payment methods actually offered to you depend on your country of residence and the device you use; the available payment methods are displayed during the ordering process.

5. Shipping

To deliver the ordered goods, we pass on the required data (name, delivery address and – if required for delivery notification – email address) to the shipping service provider DHL (Deutsche Post AG, Charles-de-Gaulle-Strasse 20, 53113 Bonn, Germany). The legal basis is Art. 6 (1) (b) GDPR. The privacy notices of the transport service provider apply to the use of shipment tracking.

We create the shipping labels via the official app “Post & DHL Shipping”, which is operated by DHL itself. As part of the label creation, the data required for shipping processing (in particular name and delivery address) is transmitted to DHL; your tracking number will be sent to you by email for shipment tracking. Further information: data protection statement of Deutsche Post DHL Group (https://www.dpdhl.com/de/datenschutz.html).

6. Shop apps and service providers (data processing on our behalf)

To operate and manage our shop, we use the following apps and service providers, which support us as processors pursuant to Art. 28 GDPR:

  • Revoq – EU Withdrawal Button (provider: BuschBytes, Germany, hosting within the EU): provision of the legally required withdrawal button (Section 356a BGB). The data processed is name, order number, email address and – if provided – a voluntary reason for withdrawal, exclusively for handling your withdrawal (Art. 6 (1) (c) and (b) GDPR). The data is deleted once the withdrawal process has been completed or after the expiry of statutory retention periods.
  • Order Printer Pro: creation of invoice and shipping documents on the basis of the respective order data (Art. 6 (1) (b) and (c) GDPR).
  • DATEV Export Pro: transfer of accounting document data (order and invoice data) to DATEV eG, Paumgartner Strasse 14–16, 90429 Nuremberg, Germany, for tax accounting purposes (Art. 6 (1) (c) GDPR).
  • PageFly AI Page Builder: design of the shop pages. When the pages are built, technical access data (e.g. IP address, browser type, page accessed) is transmitted to the provider’s servers (Art. 6 (1) (f) GDPR).
  • Cozy AntiTheft: client-side content/copy protection; it runs in your browser, and no server-side processing of personal data beyond this is known to us.
  • Bundles and Translate & Adapt: native Shopify functions (product bundles, translations); processing takes place within the scope of section 1.

7. Messaging and emails for abandoned checkouts

We use our shop’s messaging function (Shopify messaging/inbox function). If you have entered your email address in the checkout but have not completed the order, we will use it to send you an automated email with the option of completing the purchase at the conditions entered in the checkout. The legal basis is our legitimate interest in our own reminder service and in direct marketing (Art. 6 (1) (f) GDPR). You can unsubscribe from such emails at any time via the unsubscribe link contained in the email; data already stored will be deleted as soon as it is no longer required for the purpose described. If you contact us via the chat function, we process the data you communicate to us in order to handle your enquiry (Art. 6 (1) (b) and (f) GDPR).

8. Shopify Network Intelligence (SNI)

The “Shopify Network Intelligence” function (part of Shopify’s Enhanced Services) is active in our shop. SNI is an artificial intelligence and machine learning system operated by Shopify that is trained with data from our shop and other Shopify shops in order to improve shop functions and the delivery of our offering (in our shop, among other things, the automations in the messaging function and the optimal provision of payment methods in the checkout). Important: For the processing within the scope of SNI, Shopify is a controller in its own right. You can exercise your rights (in particular access, deletion and rectification, as well as an opt-out regarding the use of your data for advertising purposes) directly with Shopify: https://privacy.shopify.com. Further information, in particular on data processing in third countries (including the USA and Canada), can be found in Shopify’s Consumer Privacy Policy, which you can access via https://privacy.shopify.com.

9. Opt-out option for customers from the USA

Customers residing in the United States can opt out of the sharing or sale of their personal data for advertising purposes via our data sharing opt-out page (“Your Privacy Choices”). The Global Privacy Control (GPC) is honoured automatically.

10. Contact form and email enquiries

If you contact us via the contact form or by email, we process the data you provide (name, email address, if applicable telephone number, content of the enquiry) in order to handle your enquiry and in case of follow-up questions (Art. 6 (1) (b) or (f) GDPR). The data will be deleted as soon as it is no longer required for processing and no statutory retention obligations exist. It will not be passed on to third parties without your consent.

11. Instagram

We maintain an active presence on Instagram. The provider is Meta Platforms Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. When you visit our Instagram presence, interact with our posts or send us messages there, Meta processes personal data (e.g. usage, interaction and device data, insights data). For this processing within the scope of our Instagram presence, Meta and we are jointly responsible (Art. 26 GDPR). Information on Meta’s data processing, your rights and setting options can be found in Meta’s privacy policy (https://www.facebook.com/privacy/policy). The transfer of data to the USA is based on the European Commission’s adequacy decision on the EU-US Data Privacy Framework (10 July 2023), to which Meta has adhered. The mere links from our online shop to our Instagram profile do not in themselves trigger any data transfer.

12. Your rights as a data subject

You have the following rights vis-à-vis us:

  • pursuant to Art. 15 GDPR, the right to access your personal data processed by us;
  • pursuant to Art. 16 GDPR, the right to rectification of inaccurate data or completion of incomplete data;
  • pursuant to Art. 17 GDPR, the right to erasure (“right to be forgotten”), provided that no statutory retention obligations or other exceptions apply;
  • pursuant to Art. 18 GDPR, the right to restriction of processing;
  • pursuant to Art. 20 GDPR, the right to data portability;
  • pursuant to Art. 21 GDPR, the right to object to processing based on Art. 6 (1) (f) GDPR for reasons arising from your particular situation. If we process your data for direct marketing purposes, you may object at any time without giving reasons;
  • pursuant to Art. 77 GDPR, the right to lodge a complaint with a supervisory authority. For us, this is the State Commissioner for Data Protection and Freedom of Information Baden-Württemberg (Germany).

You may revoke any consent at any time with effect for the future, e.g. by sending an email to orders@filouino.com. To exercise your rights, simply contact us using the contact details above.

13. Storage period and deletion

We store personal data for as long as the purposes described require it or statutory retention obligations exist (including Section 257 HGB: 6 years; Section 147 AO: up to 10 years from the end of the financial year). Server log files are stored by Shopify only for a short period for operational and security purposes. Contact data is deleted once processing has been completed; withdrawal data is deleted once the withdrawal process has been completed and any existing retention obligations have expired. Data that is no longer required and is not subject to any retention obligation is deleted.

14. Data security

We use appropriate technical and organisational security measures when handling your data. Our website uses SSL/TLS encryption; this makes access to transmitted data by third parties considerably more difficult.
